Terms and Conditions
§ 1 – Scope
These General Terms and Conditions (GTC) apply to all orders placed by consumers (Section 13 of the German Civil Code) through the SAVIDIS GROUP online shop. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

§ 3 – Subject of the contract
Original, handcrafted works of art—especially paintings, sculptures, and photographs—are sold as individual pieces (one-of-a-kind). Reproduction is not permitted.
The works are sold exclusively as described in the online shop.
§ 4 – Conclusion of contract
(1) The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
(2) By submitting the order via the button “Order with payment”, the customer submits a binding offer to purchase the work.
(3) The contract is concluded when the seller accepts the customer’s offer by sending an order confirmation by email.
§ 5 – Prices and payment conditions
(1) All prices are in euros and are final prices. Due to the small business regulation (Section 19 of the German Value Added Tax Act), no sales tax is shown.
(2) Payment is made using the payment methods offered in the shop (e.g. credit card, PayPal, advance payment).
(3) Shipping will only take place after full payment has been received.
§ 6 – Delivery and shipping
(1) Delivery shall be made to the delivery address specified by the buyer.
(2) Shipping costs are displayed transparently during the ordering process and depend on size, weight and destination.
(3) The delivery time is usually 5-10 working days after receipt of payment.
§ 7 – Retention of title
The artwork remains the property of the seller until full payment has been made.
§ 8 – Right of withdrawal
Right of withdrawal for online purchases according to § 355 BGB
(1) Consumers generally have a statutory right of withdrawal of 14 days from receipt of the goods.
(2) Exclusion of the right of withdrawal:
According to Section 312g Paragraph 2 No. 1 of the German Civil Code (BGB), there is no right of withdrawal for contracts for the delivery of goods that are not prefabricated and for whose production an individual selection is decisive or which are clearly tailored to personal needs.
The works offered are unique. Therefore, a right of withdrawal is generally excluded.

§ 9 – Returns and Complaints
(1) Returns of unique items are excluded unless there is a material defect.
(2) Obvious defects or transport damage must be reported in writing within 5 working days of receipt.
(3) Slight color variations or surface irregularities do not constitute a defect, as they are part of the artistic design.
§ 10 – Copyright
(1) All works offered are subject to copyright. Upon purchase, the buyer acquires the physical work, but not the exploitation rights.
(2) Reproduction, public display or commercial use is prohibited without express written consent.
(3) The seller reserves the right to use photographs of the sold works for its own documentation and advertising purposes.
§ 11 – Liability
(1) The seller shall be liable without limitation in the event of intent and gross negligence.
(2) In the case of slight negligence, the Seller shall only be liable for breaches of essential contractual obligations and only for foreseeable damages typical for the contract.
(3) Liability for indirect damages is excluded to the extent permitted by law.
§ 12 – Final provisions
(1) The seller shall be liable without limitation in the event of intent and gross negligence.

Cancellation policy
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods.
To exercise your right of withdrawal, you must:

by means of a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but this is not mandatory.
To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.
Consequences of revocation
If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract.
For this refund, we will use the same payment method you used for the original transaction, unless expressly agreed otherwise with you. Under no circumstances will you be charged any fees for this refund.
We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us immediately and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract.
The deadline is met if you send the goods before the expiry of the fourteen-day period.
You shall bear the direct costs of returning the goods.
You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.
Exclusion or premature expiry of the right of withdrawal
The right of withdrawal does not apply to contracts for the delivery of non-prefabricated goods that have been individually selected or are clearly tailored to personal needs (Section 312g Paragraph 2 No. 1 of the German Civil Code).
Since our works are handmade unique pieces, the right of withdrawal is generally excluded.
